Embracing Islamic Values in Governance: Reflecting the Concept of ‘Madani’ In the Holy Qur’an

Malaysia Madani, a slogan introduced by the current Malaysian Prime Minister, Datuk Seri Anwar Ibrahim on January 19th, 2023, aimed at leading the country headlong by promoting the values of Sustainability, Prosperity, Innovation, Respect, Trust, and Care and Compassion. These principles resemble the shared-trust-relationship between the government and citizens; the government projects its transparency, honesty, and compassionate in conveying messages to its citizens while the people on the ground set the image of current government as dialogic, sustainable, and entrusted. Notably, these values embraced are adhered to the Islamic values of governance. The Holy Qur’an, the primary Islamic jurisprudence (Shari’ah) offers great emphasis on the humanistic relationship and ways of enhancing them which eventually the concept of MADANI reflects. Malaysia, a multicultural country embraces a variety set of values and life philosophy demands its government-citizen relationship to always keep the values of justice and benevolence.  Such perception and expectation are very significant to both as this will further empower the political ideologies of the ruling party, hence, the hegemonic position establishes.

Gender Issues and Challenges in Post Covid-19 Pandemic: A Home Economist Perspective

Gender issues and challenges in COVID -19 pandemic are presently all over the world including Nigeria. Strategies promoted to reduce gender issues and challenges in the COVID-19 pandemic have improved the situation but not resolved it. The sudden lockdown that resulted from the COVID-19 outbreak posed a great threat to the livelihoods of the entire population, leaving women more vulnerable to its resulting effects. The effects felt on the labor market were more immediate, both on demand and on labour supply. This cost many people to lose their jobs, some became unemployed, and others had to quickly adapt to new changes (telework, reduced wages, changes in work). Women employees were the hardest hit by the rules and regulations on social distancing; this is because female-dominated occupations such as education, hotel and restaurant services, care, and beauty services were the sectors hardest hit by this lockdown. The pandemic is exacerbating pre-existing gender issues and challenges exposing the vulnerabilities in economic, political, and social systems, which led to an increase in the unemployment rate. Home Economics being multidimensional and multidisciplinary area can identify and utilize innovative solutions to support people through the phase of transition to the normal time. It was concluded that skills impartation in Home Economics education, equip students with business ideas to run their own enterprises to close the gap. Recommendations were made for training and extension services to combat challenges evolve resulting from/after the pandemic era.

Legal Strength of Certificate of Property Rights to Land which is Enforced Duty for Acquisition of Land Rights Obtained

The acquisition fee for land and building rights is payable to be repaid when the acquisition of rights occurs, while on the other hand the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency in Article 33 does not require the payment of fees for the acquisition of land rights and a certificate is still issued, so that a certificate of land rights is issued which is burdened with an obligation to acquire land and building rights owed. The disharmony of this arrangement creates legal uncertainty so that it affects the legal strength of land rights certificates which are burdened with debt acquisition fees for land and building rights. Based on this background, a normative juridical research method (legal research) is used, with a legal approach and a conceptual approach. The procedure for settlement of fees for the acquisition of land and building rights in the issuance of land rights certificates in Article 33 of the Regulation of the Minister of Agrarian Affairs and Spatial Planning/National Land Agency no. 6 of 2018 is contrary to Article 9 paragraph (2) of Law no. 20 of 2000 which regulates fees for the acquisition of land and building rights, so that it does not meet one of the 8 values of legal certainty, namely that a legal system must not contain conflicting regulations. Based on the research, it can be concluded that the certificate of ownership that is charged with the acquisition of land and building rights payable in a complete systematic land registration program does not have legal force, so that it has legal consequences for the object and subject of land rights. it is necessary to harmonize the law against ATR/BPN Regulation No. 6 of 2018.
